Vertolini, LLC — Terms of Use for Our Applications
These Terms of Use ("Terms") govern your use of the mobile and web applications
published by Vertolini, LLC ("we," "us"). By downloading, accessing, or using any
of our applications, you agree to these Terms. If you do not agree, do not use the
applications. Some applications may present additional, app-specific terms; where
they conflict, the app-specific terms control for that application.
Eligibility:
You must be able to form a binding contract in your jurisdiction to use our
applications. Our applications are not directed to children under 13, and we do
not knowingly collect information from anyone under 13.
License To Use:
We grant you a personal, non-exclusive, non-transferable, revocable license to use
our applications for their intended purpose, subject to these Terms and any
applicable app store terms. You agree not to misuse the applications, interfere
with their operation, attempt to access them in unauthorized ways, or use them to
violate any law or the rights of others.
User-Generated Content (applies to applications that let you submit content):
Some of our applications — for example, applications that let you share
locations, notes, or photos on a shared map — allow you to submit content
("User Content"). You retain ownership of your User Content. You grant us a
non-exclusive, worldwide, royalty-free license to host, store, reproduce, and
display your User Content within and in connection with the application so that it
can function as intended, including showing it to other users where the
application is designed to do so. You are responsible for your User Content and
represent that you have the rights necessary to submit it.
Zero Tolerance For Objectionable Content And Abusive Behavior:
There is zero tolerance for objectionable content or abusive users. You agree not
to submit content that is unlawful, hateful, harassing, threatening, sexually
explicit, defamatory, invasive of privacy, or otherwise objectionable, and not to
harass, threaten, or abuse other users. We may remove content and suspend or
terminate accounts that violate these Terms.
Reporting, Blocking, And Moderation:
In applications that include User Content, you can report objectionable content
and block abusive users from within the application. We review reported content
and remove content and users that violate these Terms, with the goal of acting on
reports within 24 hours. Content reported by multiple users may be hidden
automatically pending review.
Location And Safety:
Some applications use or record location. Do not interact with an application while
driving or otherwise operating a vehicle in a manner that distracts you. Use our
applications only when it is safe to do so. Locations and other user-submitted
information may be approximate and are provided without warranty.
Accounts And Deletion:
Some applications offer an account, which may be anonymous (tied to your device) or
linked to a sign-in provider such as Sign in with Apple. Where an application
supports account creation, you may delete your account and associated data from
within the application, or by contacting us at support@vertolini.com.
Privacy:
Our handling of your information is described in our Privacy Policy, available at
https://www.vertolini.com/privacy.html and within our applications.
Disclaimers And Limitation Of Liability:
NO WARRANTY. Our applications and their content, including user-submitted content,
are provided "AS IS" and "AS AVAILABLE," with all faults and without warranties of
any kind, whether express, implied, or statutory. To the maximum extent permitted
by law, Vertolini, LLC expressly disclaims all warranties, including but not limited
to any implied warranties of merchantability, fitness for a particular purpose,
title, and non-infringement. We do not warrant that the applications will meet your
requirements, be fit for any particular purpose, be uninterrupted, timely, secure,
or error-free, or that any defects will be corrected. You use the applications at
your own risk. To the maximum extent permitted by law, Vertolini, LLC is not liable
for any indirect, incidental, special, consequential, or punitive damages, or any
loss arising from your use of, or reliance on, the applications or any
user-submitted content.
Changes To These Terms:
We may update these Terms from time to time. Changes are effective when posted.
Your continued use of an application after changes take effect constitutes
acceptance of the updated Terms.
